The Smart Ear Camera is a home visual tool and not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Consult with a healthcare professional for any medical concerns.

You agree to indemnify, defend and hold harmless Smart Ear Camera and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

11. Governing Law and Dispute Resolution

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the jurisdiction where Smart Ear Camera is incorporated, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or your use of the Site will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify.
